Terms of use

Effective date: November 5, 2026. PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 14) THAT AFFECT YOUR LEGAL RIGHTS. BY CREATING AN ACCOUNT, CHECKING THE AGREEMENT BOX, OR USING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

1. About the Services. We The Vote provides the website, mobile app, and Vote Map (the "Services") as an independent, nonpartisan informational tool. We The Vote is not a government agency, election authority, political party, campaign, or political committee, and is not affiliated with or endorsed by any of them.

2. Not official results; no verification. Community Reports are voluntary, unverified, self-reported submissions from a self-selected group of users. They are not official results, not a scientific poll, and not a statistically representative sample. We The Vote does not verify, certify, audit, or validate any election, ballot, or vote count. Nothing in the Services is, or should be interpreted as, a claim, allegation, finding, or evidence of fraud, irregularity, misconduct, or wrongdoing by any person, official, or jurisdiction. Differences between Community Reports and official results are expected. Always rely on your state and local election officials for official information.

3. Informational purposes only. All content is provided for general informational and educational purposes only and does not constitute legal, political, voting, or professional advice. You are solely responsible for any decisions you make or actions you take based on the Services.

4. Eligibility. You must be at least 18 years old and a resident of the United States. You represent that all information you provide is truthful and that you will submit reports only about your own selections in elections in which you were eligible to participate.

5. Your account. You are responsible for all activity under your account and for keeping your sign-in methods secure. Notify us immediately at bsdryan.miller@gmail.com of any unauthorized use.

6. Acceptable use. You agree not to: submit false, duplicate, or fabricated reports; use bots, scripts, or automated means; impersonate anyone; manipulate or attempt to manipulate data or totals; scrape or harvest data; interfere with or disrupt the Services; use the Services to intimidate, harass, or mislead voters; use the Services to spread claims that elections were fraudulent based on Community Reports; violate any federal, state, or local law, including election laws; or encourage others to do any of these things.

7. Your content and license. You retain ownership of what you submit, but you grant We The Vote a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, store, aggregate, analyze, de-identify, display, publish, and create derivative works from your submissions for any lawful purpose. You waive any moral rights and any claim to compensation.

8. Moderation. We may, but are not obligated to, monitor, review, remove, hide, or exclude any submission or account at any time, for any reason or no reason, without notice or liability. We are not responsible for user submissions and do not endorse them. We The Vote is entitled to all protections available under 47 U.S.C. § 230 and similar laws.

9. Intellectual property. The Services, including the We The Vote and Vote Map names, logos, design, software, and content (excluding user submissions), are owned by We The Vote and protected by law. You may not copy, modify, distribute, or create derivative works except as expressly permitted.

10. Third-party services and data. The Services may include data, links, or features from third parties, including government sources and sign-in providers. We do not control and are not responsible for their accuracy, availability, or practices.

11. DISCLAIMER OF WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA IS ACCURATE OR CURRENT.

12. LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE THE VOTE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS (THE "WE THE VOTE PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATING TO THE SERVICES, ANY CONTENT, OR THESE TERMS, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY. THE WE THE VOTE PARTIES' TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

13. Indemnification. You agree to defend, indemnify, and hold harmless the We The Vote Parties from and against any claims, demands, investigations, inquiries, penalties, fines, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your submissions, your violation of these Terms, or your violation of any law or the rights of any third party, including any inquiry or proceeding by a government or regulatory authority.

14. BINDING ARBITRATION AND CLASS ACTION WAIVER. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court, except that either party may bring an individual claim in small claims court, and either party may seek injunctive relief for intellectual property misuse. The Federal Arbitration Act governs this section. YOU AND WE THE VOTE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or award relief on a class basis. You may opt out of this section by emailing bsdryan.miller@gmail.com within 30 days of first accepting these Terms with your name, account email, and a clear statement that you opt out. If the class action waiver is found unenforceable, this entire arbitration section will be void.

15. Time limit for claims. To the extent permitted by law, any claim relating to the Services must be filed within one (1) year after it arises, or it is permanently barred.

16. Governing law and venue. These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 14, any permitted court proceeding will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

17. Compliance and cooperation. We may preserve and disclose information and cooperate with law enforcement and election authorities when we believe in good faith it is required by law or necessary to protect the integrity of the Services, our rights, or the safety of others.

18. Termination. We may suspend or terminate your access at any time, for any reason, without notice or liability. Sections 2, 3, 7, and 9 through 21 survive termination.

19. Changes to the Services and Terms. We may modify, suspend, or discontinue any part of the Services at any time. We may update these Terms; the updated version will be posted with a new effective date, and continued use after posting constitutes acceptance.

20. Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including outages, cyberattacks, government action, or failures of third-party data sources.

21. General. These Terms, the Privacy Policy, and the Methodology page are the entire agreement between you and We The Vote. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them freely. No agency, partnership, or joint venture is created.
